New Motor Vehicle Damage Act


Pennsylvania law provides protections to individual who purchase new motor vehicles that have been damaged before purchase.  This law is called the New Motor Vehicle Damage Act.

 

This law sets forth that dealerships must notify the purchaser of a new motor vehicle in writing at the time of sale of any damage or damage repairs incurred by the new motor vehicle, regardless of whether the damaged portion was repaired or replaced to its pre-damaged condition, which exceeds the greater of $500 or 3% of the manufacturer's suggested retail price.

 

This type of damage could occur on a test drive, while the vehicle was a demonstrator, when it was pulled off of the transporter truck, while it was getting detailed, or any other scenario.


So in practice, this law imposes a duty upon a dealership to notify you if your new vehicle was damages prior to sale. If the dealer fails to notify you of the damage, you can commence a lawsuit to recover the purchase price of the vehicle.
